Privacy Policy
1. Controller
The With Max application and the website therealmax.ai (the "Service") are operated by PRONAXIS SAS, 49 rue de Ponthieu, 75008 Paris, France ("we", "us"), the controller of the personal data processed through the Service. Contact: hello@therealmax.ai.
2. Data we process
- Account data: email address and, where you sign in with a third-party provider, the identifiers and name that provider shares.
- Content: the information you provide to the Service, including messages, images and files.
- Profile data: information about you and your training that you provide or that the Service generates from your use of it.
- Health and fitness data: data relating to your physical condition and activity, including data you choose to share from Apple Health.
- Technical data: data necessary for the operation and security of the Service, such as IP address, approximate location derived from it (country and city), device type, time zone and application version.
3. Purposes and legal bases
We process personal data to provide the Service and its features, on the basis of the performance of our contract with you (Art. 6(1)(b) GDPR); to secure, understand and improve the Service and comply with legal obligations (Art. 6(1)(c) and (f) GDPR). Health data is processed only with your explicit consent (Art. 9(2)(a) GDPR), which you may withdraw at any time.
4. Artificial intelligence
The Service uses artificial intelligence to generate its coaching. Personal data is processed for this purpose by AI service providers acting as our processors, under contract, and is not used by them to train their models. The Service does not make decisions producing legal or similarly significant effects on you. Conversations may be reviewed automatically by an AI system to keep the Service safe and to improve it. They are not read by our staff, except where a safety concern requires it.
5. Apple Health
Where you grant access, data obtained through Apple HealthKit is used solely to provide the Service. It is not used for advertising, marketing or data mining, is not sold, and is not disclosed to third parties other than processors acting on our behalf to provide the Service.
6. Recipients
Personal data is disclosed only to service providers processing it on our behalf (hosting, data storage, artificial intelligence, communications), bound by contract and confidentiality, and to authorities where required by law. We do not sell personal data and do not use it for advertising.
7. International transfers
Personal data is stored in the European Union. Where a processor is located outside the European Economic Area, transfers are governed by the European Commission's Standard Contractual Clauses or another lawful safeguard.
8. Retention
Personal data is kept for as long as your account exists, then deleted, save where retention is required by law. Connection logs (IP address, date, approximate location) are kept for 12 months. Backups are overwritten on a rolling basis.
9. Your rights
You have the right to access, rectify, erase, restrict and object to the processing of your personal data, to data portability, and to withdraw consent at any time, by writing to hello@therealmax.ai from the email address linked to your account. Account deletion requests are completed within 30 days. You may lodge a complaint with the CNIL (www.cnil.fr).
10. Security
We apply appropriate technical and organisational measures to protect personal data.
11. Medical disclaimer
The Service is a training coach. It is not a medical device and does not provide medical advice, diagnosis or treatment.
12. Children
The Service is not intended for persons under 16.
13. Changes
We may update this policy. The current version and its effective date are published on this page.
